In consideration of being allowed to participate in any way in the sport and activities of Bullpen LLC, I, the undersigned, acknowledge, appreciate, and agree that:

Release of Liability:
I hereby release and waive my rights to sue Bullpen LLC, its officers, employees, coaches, volunteers, agents, representatives, and any other individuals associated with Bullpen LLC (collectively "Released Parties") from any and all liability, claims, or demands arising from injury, loss, or damage to my person or property, whether caused by the negligence of the Released Parties or otherwise.

Indemnification:
I agree to indemnify, hold harmless, and defend the Released Parties from any loss, liability, damage, or cost they may incur due to my participation in the Bullpen LLC activities, whether online, in-person, or otherwise.

Assumption of Risk:
I willingly and freely assume all risks associated with my participation in Bullpen LLC activities, including but not limited to, risk of injury, illness, and damage to my person or property. I understand the specific risks associated with baseball and softball activities, including but not limited to, being hit by a ball or bat, collisions with other players or equipment, and overexertion.

Emergency Medical Treatment:
I consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during the activities.

Media Release:
I grant Bullpen LLC the right to take photographs or video footage of me during my participation in activities. I authorize Bullpen LLC to use such media for any lawful purpose, including but not limited to, publicity, illustration, advertising, and web content.

Compliance with Policies:
I agree to comply with all rules, regulations, and safety procedures established by Bullpen LLC for my well-being and to minimize the risk of injury or contraction of diseases.

Severability:
If any clause or provision set forth in this waiver is determined to be illegal, invalid, or unenforceable under present or future law, then it shall be severable without affecting the enforceability of all remaining clauses or provisions.

Acknowledgement of Understanding:
I have read this waiver of liability, fully understand its terms, and understand that I am relinquishing substantial rights by signing it. I acknowledge that I am signing this agreement freely and voluntarily, and intend my signature to serve as confirmation of my complete and unconditional acceptance of the terms, conditions, and provisions set forth.

If the participant is a minor, I certify that I am the participant's parent or legal guardian and I make these representations and provide my agreement to this waiver and release on the participant's behalf.

Cancellation Policy (Programs):
In the event of an early cancellation of programs paid monthly, the charges incurred will be calculated on a prorated basis according to the rate applicable to the actual program(s) utilized. The client will be charged the difference between the prorated amount and any fees previously paid.

Cancellation Policy (Camps):
In the event of an early cancellation, we reserve the right to assess whether extenuating circumstances warrant a refund or adjustment of charges incurred. Should we determine that such circumstances exist, we may calculate any potential refund on a prorated basis in accordance with the rate applicable to the actual program(s) and/or services or work completed or utilized. The client will be responsible for any difference between the prorated amount and any fees previously paid.

Cancellation Policy (Onboarding):
All payments for this service are non-refundable. In the event of cancellation, no refunds will be issued for any fees paid. We appreciate your understanding and commitment to our programs.

The Bullpen ensures the protection of its data and information through secure access controls and measures. Data and information collected may be used for business purposes, including operational and analytical needs. We comply with applicable laws and retain the right to manage information as required for our business operations. We reserve the right to make informed decisions about how to distribute information and which information to disseminate.
